(1) In the following, we inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g., name, address, email addresses, user behavior.

§ 2 Data Subject Rights
(1) You have the following rights regarding your personal data:
- Right of access (Art. 15 GDPR),
- Right to rectification or erasure (Art. 16 and 17 GDPR),
- Right to restriction of processing (Art. 18 GDPR),
- Right to object to processing (Art. 21 GDPR),
- Right to data portability (Art. 20 GDPR).
(2) You also have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data.
§ 3 Collection of Personal Data when Visiting our Website
(1) When using the website for informational purposes only, i.e., if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- Amount of data transferred in each case
- Website from which the request originates
- Browser
- Operating system and its interface
- Language and version of the browser software.
(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive, assigned to the browser you are using, and through which certain information flows to the entity that sets the cookie (in this case, us). Cookies cannot execute programs or transmit viruses to your computer. They serve to make the internet offering more user-friendly and effective overall.

a) This website uses the following types of cookies, the scope and function of which are explained below:
- Transient cookies (see b)
- Persistent cookies (see c)
- Third-party cookies (see d).
b) Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the common session. This allows your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close the browser.
c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies in your browser’s security settings at any time.
d) Third-party cookies are offered by other third-party providers who are not the controller of the website. These are used for identification for reach measurement or marketing purposes.
e) You can configure your browser settings according to your wishes and, for example, refuse the acceptance of third-party cookies or all cookies. We would like to point out that you may not be able to use all functions of this website.
§ 4 Further Functions and Offers of our Website
(1) In addition to the purely informational use of our website, we offer various services that you can use if interested. For this, you generally need to provide further personal data, which we use to provide the respective service and for which the aforementioned principles for data processing apply.
(2) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.
(3) We also employ technical and organizational security measures to protect personal data collected or generated, in particular against accidental or intentional manipulation, loss, destruction, or against attack by unauthorized persons. Our security measures are continuously improved in line with technological developments.
(4) We allow some of our partners to place their logo and a link on our website if we believe that these companies might be of interest to you. In these cases, the third party may receive your IP address and other data from your browser when the browser retrieves and displays content originating from the third parties. This may include the data mentioned in § 3 (1).
(5) Furthermore, we may pass on your personal data to third parties if participation in promotions, competitions, contract conclusions, or similar services are offered by us jointly with partners. You will receive more detailed information on this when you provide your personal data or below in the description of the offer.
(6) Insofar as our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you about the consequences of this circumstance in the description of the offer.
§ 5 Objection or Revocation against the Processing of your Data
(1) If you have given consent to the processing of your data, you can revoke it at any time. Such a revocation affects the permissibility of processing your personal data after you have expressed it to us.
(2) Insofar as we base the processing of your personal data on a balancing of interests, you can object to the processing. This is the case if the processing is not necessary for the fulfillment of a contract with you, which is explained by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and either stop or adjust the data processing or show you our compelling legitimate grounds on which we continue the processing.
(3) Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. You can inform us of your advertising objection using the following contact details: privacy(at)marche-int.com.
§ 6 SSL or TLS Encryption
(1) For security reasons and to protect the transmission of confidential content, we use SSL or TLS encryption on our website. This allows inquiries via the contact form or orders via the site to be transmitted securely. You can recognize SSL or TLS encryption by the addition “https://” in the address bar of your internet browser and a closed padlock symbol displayed next to it.
(2) If SSL or TLS encryption is activated, data can be transmitted to us via the website without being read by third parties.
§ 7 Email Contact and Use of the Contact Form
(1) To contact us, you can use the contact form, email address, phone number, or the specified social networks to submit inquiries, reservations, requests, and feedback. Personal data, such as name, email address, or phone number, will be processed. We process the data provided by the user exclusively for contacting them and processing their related request.
(2) The legal basis for the processing of this data is, according to Art. 6 para. 1 sentence 1 lit. f GDPR, our legitimate interest in contacting you and processing your request.
(3) If the inquiry via the contact form or email leads to a contract, the processing of the provided data is necessary for the fulfillment of a contract. The legal basis for this is Art. 6 para. 1 sentence 1 lit. b GDPR.
(4) The provided data will be processed until it is no longer required for the purpose. The purpose is no longer applicable when the user’s concern has been conclusively clarified and contact has ended.
(5) The user has the option to object to data processing at any time. In this case, the data provided for contact will be deleted and no longer used. The objection should be sent to the following email address: privacy(at)marche-int.com.
§ 8 Newsletter Subscription
(1) We offer a newsletter on our website in which we inform you about our products and services as well as various offers. Personal data is collected when you subscribe to the newsletter. Your email address is necessary to send you the newsletter. All other information you provide is voluntary and is only used for personal addressing in the newsletter.
(2) The legal basis for the processing of data during newsletter registration is, according to Art. 6 para. 1 sentence 1 lit. a GDPR, your consent.
(3) We only store your provided data once you have given us effective consent. To legally obtain your consent, we use the so-called double opt-in procedure. For this, we send you a message with a confirmation link to the email address you entered. If you confirm this link, you have successfully subscribed to the newsletter. If you do not confirm this link within 24 hours, it will expire. With this confirmation, we store your email address, IP address, and the time of registration. This data serves as proof of registration and to detect possible misuse of your personal data.
(4) You can revoke your given consent for the newsletter at any time. You can send this to privacy(at)marche-int.com or by clicking the unsubscribe link in a newsletter you received from us. If you revoke your consent or unsubscribe from the newsletter, you will no longer receive newsletters in the future, and we will delete your data provided in this regard.
(5) We use success measurement for our newsletters. The newsletters contain a so-called “web beacon”, i.e., a pixel-sized file that is retrieved from our server, or, if we use a shipping service provider, from their server, when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and the time of retrieval, are collected. This information is used for the technical improvement of the services based on technical data or target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or access times. The statistical surveys also include determining whether newsletters are opened, when they are opened, and which links are clicked. Although this information can be assigned to individual newsletter recipients for technical reasons, it is neither our endeavor nor, if used, that of the shipping service provider, to observe individual users.
The legal basis for this data processing is Art. 6 para. 1 lit. f GDPR (balancing of interests) in conjunction with our interest in recognizing the reading habits of our users and adapting our content to them or sending different content according to the interests of our users.
If you do not wish to be included in the success measurement, you can object by unsubscribing from the newsletter. To do this, you can click the link contained in every newsletter or send your objection to privacy(at)marche-int.com. In this case, you will no longer receive newsletters in the future.
§ 9 Reservation System “resmio”
(1) We use the reservation system “resmio” from the provider resmio GmbH, Katzwanger Str. 150, 90461 Nuremberg, on our website. This allows site visitors to make table reservations for our restaurant.
(2) The legal basis for using the reservation system “theFork” and “resmio” is to facilitate reservations and optimize our business operations. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.
(3) Two types of data about the user are stored here. Firstly, data that you transmit to the third-party provider in the course of your requested reservation in one of our restaurants that personally identifies the user (such as name, email address, or contact details). Secondly, data that is relevant for the use of partner websites (such as dwell time or geographical data).

§ 10 TripAdvisor
(1) We use TripAdvisor on our website. TripAdvisor is a product of TripAdvisor LLC, 160 Greentree Drive, Suite 101, Dover, Delaware, 19904, USA. This allows site visitors to submit reviews about our services. We can use these reviews to improve and design our services. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.
(2) The service is not directly embedded on our website but provides a link to the TripAdvisor site. User information is only transmitted to TripAdvisor after the link is activated (clicking the link or the corresponding icon).
(3) Further information on the handling of user data can be found in the privacy policy of TripAdvisor.
§ 11 Lieferando
(1) We use Lieferando on our website. Lieferando is a product of Takeaway.com N.V., Oosterdoksstraat 80, 1011 DK Amsterdam, Netherlands. This allows site visitors to place online orders and have them delivered to their home or office. We use this product to better design our services. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.
(2) The service is not directly embedded on our website but provides a link to the Lieferando site. User information is only transmitted to Lieferando after the link is activated (clicking the link).
(3) Further information on the handling of user data can be found in the privacy policy of Lieferando.
§ 12 Data Protection for Applications and in the Application Process
(1) We collect and process personal data from applicants who send their data to us via email, a corresponding contact form, an application portal, or by post. This includes name, address, contact details, qualifications, and other proofs. We process the provided data for the purpose of handling the application process. The legal basis for this is Art. 88 para. 1 GDPR in conjunction with § 26 para. 1 new BDSG. For applications in Austria, we use the services of Bluedrop GmbH. Further information on the handling of user data can be found in the privacy policy of Bluedrop GmbH.
(2) If the application process is successful and leads to the conclusion of an employment contract with the applicant, the data transmitted by the applicant will be further processed for the purpose of handling the employment relationship according to Art. 88 para. 1 GDPR in conjunction with § 26 para. 1 new BDSG.
(3) If the application process ends without the conclusion of an employment contract with the applicant, the data provided by the applicant will be deleted no later than 6 months after the decision is announced. The reason for this is our other legitimate interests, e.g., for the documentation of the duty to provide evidence and proof for possible proceedings under the General Equal Treatment Act.
(4) If the applicant wishes to be considered for other potential positions in the company despite rejection in the application process, we will obtain their consent for further processing of the data. The applicant’s data will be deleted 2 years after consent is granted, unless the applicant withdraws their consent at an earlier date. The same applies to unsolicited applications.
(5) The revocation must be sent to the following email address: privacy(at)marche-int.com.
§ 13 Use of Google Analytics
(1) We use Google Analytics on our website. Google Analytics is a tracking tool provided by Google Ireland Ltd., Gordon House, Barrow Street, Bublin 4, Ireland. More information is available here:
(2) Google Analytics stores cookies on your computer, which can be used to analyze the use of our website. Data such as the user’s IP address, the website accessed, the website from which the user accessed our website, the subpages accessed from the accessed page, the time spent on the site and the frequency with which our website is accessed are stored. The information generated by the cookie is usually transferred to a Google server in the USA and stored there. If IP anonymization is activated on our website, your IP address will be shortened by Google within the member states of the European Union or in another contracting state of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. This data is used to compile information about the use of the website and reports, as well as to improve our offer and make the website more interesting.
(3) We use Google Analytics on our website with the extension “_anonymizeIp()”. This shortens your IP address so that it can no longer be linked to your person.
(4) The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
(5) For exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield.
(6) The legal basis for processing data using Google Analytics is our special interest pursuant to Art. 6 Para. 1 S. 1 lit. f GDPR for analyzing and improving the design of our website.
(7) If you want to prevent the setting and storage of cookies, you can do so by adjusting your browser settings accordingly. In this case, however, we would like to point out that you may not be able to use all functions of our website in full. You can also prevent Google Analytics from setting a cookie to process your data by downloading and installing the browser plug-in here.
As an alternative to the browser plug-in, you can click “this link” to prevent collection by Google Analytics on this website in the future. An opt-out cookie will be stored on your device, which prevents tracking. If you delete your cookies, you must click the link again.
§ 14 Use of Google ReCaptcha
(1) We use the Google ReCaptcha function of Google LLC on our website to prevent misuse of our offered content. This system helps us identify whether the user is a natural person or an internet bot.
(2) To use the Google ReCaptcha function, it is necessary to store the IP address and, if applicable, other data of the page visitor. This information is usually transferred to a Google server in the USA and stored there. We have no influence on the data transfer.
(3) Google ReCaptcha is used in the interest of avoiding misuse through automated or mechanical processing of the offers provided on our website. This constitutes a legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR.

§ 15 Social Media Applications
(1) On our website, we use links to social networks such as Facebook, Instagram, Xing or LinkedIn. We use these applications to spread our offers and content more easily and make them available to a larger audience. This constitutes a legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR.
(2) These services are not directly embedded on our website, but only provide links to the website of the social networks. User information is only transferred to the respective service of the social network after the link has been activated (clicking on the link or the corresponding icon).

§ 16 Integration of YouTube videos
(1) We have embedded YouTube videos on our website that are stored and viewable on the Youtube platform. YouTube is a platform of Google LLC. The videos are embedded on our website in the extended data protection mode, which is why no personal data from you as a visitor to our site is automatically transferred to YouTube. The data mentioned in paragraph 2 will only be transferred if you also play the videos. We have no influence on the data transferability.
(2) When you visit our website, YouTube receives information that you have accessed the corresponding subpage and the data mentioned under § 3. This happens regardless of whether you have a YouTube user account or not. If you have a YouTube user account and are logged in via your Google account at the time of your visit to our website, this data will be assigned directly to your user account. If you do not want the data to be merged with your user account, you must log out before activating the button. YouTube uses this data to create user profiles, but also for advertising purposes, market research or to design its websites to meet your needs. You have the option to object to the creation of such user profiles. However, you must address this objection directly to YouTube.

§ 17 Integration of Vimeo Videos
(1) We have integrated videos from the “Vimeo” platform on our website. “Vimeo” is a platform of the provider Vimeo Inc, Attention: Legal Department, 555 West 18th Street New York, New York 10011, USA. We use “Vimeo” to make our website and our services more appealing. This constitutes a legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR.
(2) When you visit one of our websites equipped with a Vimeo plug-in, a connection is established to the “Vimeo” servers. The Vimeo server is informed which of our pages you have visited.

§ 18 Integration of Google Maps
(1) We use Google Maps on our website. Google Maps is an offer from Google Inc., 1600 Amphitheater Parkway, Mountainview, California 94043, USA. This service allows us to show interactive maps and enables users to use the map function conveniently.
(2) When you visit our website, Google receives information that you have accessed the corresponding subpage and the data mentioned under § 3. This happens regardless of whether you have a Google user account or not.
