Terms and Conditions
§ 1 Organizer
The contest, running from November 17 to December 1 at 3 PM, is organized by

hereinafter referred to as the “Organizer.” Participation is free of charge and not dependent on the purchase of goods or the use of a service.
§ 2 Subject of the Contest
(1) This contest is promotional in nature. The contest is accessible via the Marché Mövenpick Deutschland GmbH company pages on Facebook and Instagram at https://www.facebook.com/MarcheDeutschland/ and https://www.instagram.com/marchedeutschland/, respectively.
(2) The execution of the contest is not connected to Facebook/Instagram and is not sponsored, supported, or organized by Facebook/Instagram.
§ 3 Eligibility
(1) All persons aged 18 or older who reside in the Federal Republic of Germany and are not employees of Marché Deutschland are eligible to participate. Participation with fake identities or identities of third parties is not permitted.
(2) Furthermore, if selected as a winner, the participant must provide their personal data, such as name, first name, email address, and postal address (for sending any prizes), once and truthfully. The absence of any of these mandatory details will lead to the exclusion of the participant concerned from the contest.
(3) Only one entry per participant is allowed. Repeated participation may result in the loss of eligibility at the Organizer’s discretion.
(4) Participation is free of charge and independent of the purchase of goods or services. By participating in the contest, the participant accepts these terms and conditions.
(5) A violation of these terms and conditions entitles the Organizer to exclude the respective participant from participation. This applies in particular if the participant provides false information. If the excluded participant is an already drawn winner, the prize can be subsequently revoked.
§ 4 Prize
(1) The prize to be won online on Instagram between November 17, 2025, and December 1, 2025, at 3 PM, is a table for 4 people worth €616 for the Sanuk event at Zoo Leipzig on December 6, 2025. Non-alcoholic beverages, hot drinks, wine, and beer are included.
(2) Participation in both contests is by posting a comment, tagging the desired companion, and sharing the post.
(3) Cash payment of the prize value and exchange of the prize are excluded. The prize is not transferable.
(4) The Organizer assumes no liability for the usability of the prize.
§ 5 Winner Determination, Notification, and Transfer
(1) Among the participants, the Organizer will determine the respective winner by random selection using the tool: https://www.fanpagekarma.com/facebook-promotion on the same day after the entry deadline (defined in the posting text).
(2) Winners will be informed via private message. The winner must respond to the drawing by Wednesday, December 3, 2025, at 3 PM. If the winner does not respond within the specified period, the prize will be redrawn among all participants.
(3) All communications will be via personal messages. The participant hereby grants the Organizer permission to contact them via “personal messages.”
§ 6 Prize Handover; Prize Realization
(1) Prizes will be delivered via email, Instagram message, or postal mail after the winner’s response.
(2) Participants are responsible for any address changes, errors in address and name details, and for absence during the notification period. There is no claim for replacement in case of loss of the package. The risk of accidental loss of the goods passes to the respective winner upon dispatch of the respective prize by post. The Organizer is not responsible for delivery damages.
§ 7 Exclusion of Legal Recourse
Legal recourse is excluded both with regard to the conduct of the contest and the decision and awarding of prizes.
§ 8 Suspension of the Contest; Amendment of Terms and Conditions
(1) The Organizer reserves the right to terminate the contest prematurely, in whole or in part, at any time, even without notice, or to modify its course, insofar as it is not possible to guarantee the proper conduct of the contest for technical (e.g., computer virus, manipulation of or errors in software/hardware) or legal reasons.
(2) The Organizer further reserves the right to amend these terms and conditions without prior notice.
§ 9 Limitation of Liability and Indemnification
(1) Any obligation of the Organizer and its organs, employees, and vicarious agents to pay damages arising from or in connection with the contest, regardless of the legal reason, is, to the extent legally permissible, limited to cases of intent or gross negligence.
(2) By participating in the contest, the user indemnifies Facebook from any liability.
§ 10 Exclusion
A violation of these terms and conditions entitles us to exclude the respective user from participation. This applies in particular if the participant provides false information or if content (e.g., comments) violates applicable law or the rights of third parties. The same applies to comments that can be considered glorifying violence, offensive, harassing, or derogatory, or that otherwise violate public decency. Users are responsible for any legal infringements.
§ 11 Data Protection
(1) Our general data protection provisions apply, which can be found here.
We are responsible for the collection, processing, and use of participants’ personal data, provided we process it ourselves. We will only use the participant’s personal details and other personal data within the framework of data protection law. We will only store, process, and use the information to the extent necessary for the execution of the contest or if the participant has given their consent. This also includes use for exercising the granted rights of use. The data will be used exclusively for the execution of the contest.
The participant agrees that their name and profile picture will be mentioned and published on the Marché Deutschland Instagram page during the contest and in the event of a win.
(2) The personal data provided by participants within the scope of the contest will be collected, stored, used, and – for example, for the purpose of prize delivery – passed on to third parties exclusively by the Organizer or its agents for the purpose of conducting and processing the contest.
(3) No further use will take place.
§ 12 Applicability of Facebook Policies
Furthermore, Facebook’s policies for organizing contests, available at: https://www.facebook.com/policies/pages_groups_events/, and Facebook’s advertising policies, available at: https://www.facebook.com/policies/ads, in their currently valid versions, shall apply.
§ 13 Final Provisions
(1) Should the terms and conditions contain ineffective provisions, the validity of the remaining terms shall remain unaffected.
(2) German law applies. Legal recourse for reviewing the drawing is excluded.
